Packaging EPR authorised representative in Spain

The Packaging and Packaging Waste Regulation (Regulation (EU) 2025/40) applies from 12 August 2026. Under Article 45(3), a producer that supplies packaging or packaged products directly to end users in a Member State where it is not established must appoint an authorised representative for extended producer responsibility in that country. Online marketplaces must check that sellers are registered.

What this means in Spain

  • Registration in the packaging section of the Registro de Productores de Producto run by MITECO.
  • Membership of a collective scheme for packaging.
  • An annual declaration of the packaging placed on the Spanish market, due by 31 March.

A Commission proposal would suspend the authorised-representative duty for producers established in another EU country. Producers outside the EU are not covered by that proposal and must appoint one.

Who needs it

  • Sellers outside the EU shipping packaged goods to consumers in Spain, including through Amazon, Temu, Shein, TikTok Shop or their own store.
  • Companies in other EU countries selling directly to Spanish consumers, until the suspension proposal is decided.

What we do

  1. Confirm whether you are the producer for Spain and which packaging flows count.
  2. Sign a separate EPR mandate for Spain.
  3. Register you in the producer register and connect you with a collective scheme.
  4. Collect packaging data and file the annual declaration.
  5. Give you the registration number for marketplace listings.
