Late payment recovery for B2B invoices in Spain
Spain's late payment law (Ley 3/2004) protects businesses that sell to other businesses. When a business customer pays late, the supplier is entitled to:
- statutory late-payment interest, set at the European Central Bank rate plus eight percentage points, from the day after the due date;
- €40 fixed compensation per invoice for recovery costs, without having to prove them;
- a maximum payment term of 60 days in most B2B contracts, whatever the contract says.
Many suppliers never claim these amounts because calculating and chasing them takes time.
What we deliver
- Calculation — interest and fixed compensation for each overdue invoice.
- Reminders — a polite, firm sequence of reminder letters by email and post.
- Negotiation — a written settlement proposal, which also serves as the out-of-court negotiation attempt that Spanish civil procedure has required since April 2025 before most claims.
- Escalation — if the customer still does not pay, we hand the prepared file to a lawyer of your choice or from our network for court action.
We do not represent you in court; litigation is handled by lawyers.
